PROVIDENCE, R.I. (AP) – A 48-year-old Providence man accused of fatally beating a car dealer with a two-by-four in a fight over a truck is back in jail after a judge refused bail.
The Providence Journal reports that Daniel Lastarza lost his round in court on Thursday.
District Court Judge Christine S. Jabour cited Lastarza’s criminal record and said he had “slapped five” with another man involved in the fight.
The judge said he brought a two-by-four to a fistfight, which she said was not reasonable force.
Lastarza is accused of killing 33-year-old Jonathan Stack in a July 23 fight behind a bar. His lawyer said he was trying to protect a friend.
Police say Lastarza was wanted the return of $400 he paid for a truck that did not belong to the seller.
