The Attorney General’s office has cleared police in the use of deadly force in shooting a Tiverton man who struggled with his wife in their home in April.
The review found Tiverton Police Lieutenant Scott Beaulieu complied with state laws on the use of deadly force and self-defense when he shot Scott Banville twice in the shoulder through the window of his Pelletier Lane home, as Banville threatened his wife and responding officers with a .50 caliber muzzle loader rifle on April 4, 2018.
“Banville had been drinking approximately six beers in the hours prior to the argument and became upset after reading a text on his wife Marie’s phone,” the review found.
“During the argument, Banville threatened to kill himself and retrieved his rifle from his bedroom.” The report went on to discuss an ongoing struggle between Banville and his wife, who was able to contact her sister in New Jersey who called Tiverton police.
Several officers responded to the home along Stafford Pond. Two young children were in the home at the time of the struggle and subsequent police shooting, said Police Chief Patrick Jones at the time of the incident.
Banville, 45, is free while awaiting “felony screening” on felony assault and misdemeanor domestic violence and disorderly conduct charges.
